K팝 소속사 어도어가 인기 그룹 뉴진스의 전 멤버를 상대로 수백만 달러의 손해배상 소송을 제기했다고 발표했다. 멤버들이 부당한 대우를 주장하며 계약 이탈을 시도한 1년간의 분쟁 끝에 해당 멤버를 그룹에서 제외한 다음 날이다.

호주 출신의 20세 가수 다니엘 마쉬를 상대로 한 손해배상 소송은, 서울 지방법원이 뉴진스 다섯 멤버 모두 어도어와의 계약을 이행해야 한다고 판결한 지 수개월 만에 나왔다. 어도어의 모회사 하이브는 K팝 센세이션 방탄소년단(BTS)의 소속사이기도 하다. 뉴진스의 계약은 2029년까지 유효하다.

어도어는 다니엘의 익명의 가족 구성원 한 명과 그룹의 전 프로듀서 민희진도 함께 고소했다. 손해배상과 계약 위반 위약금을 청구하며, 두 사람 모두 “이번 분쟁을 야기하고 뉴진스의 이탈과 지연된 복귀에 중대한 책임이 있다”고 주장했다.

연합뉴스에 따르면 세 사람에게 청구하는 총액은 약 431억 원(미화 3,000만 달러)에 달한다.

뉴진스는 2024년 11월 어도어를 떠나겠다고 발표하면서 헤드라인을 장식했고, 이에 어도어는 멤버들의 모든 상업 활동을 금지하는 가처분을 신청했다. 이 신청은 3월에 인용됐다.

어도어는 월요일 다니엘과의 계약을 해지했다고 밝히며 “어도어 소속 아티스트로서 함께하기 어렵다고 판단했다”고 전했다.

소속사는 뉴진스 멤버들이 “지속적으로 왜곡되고 편향된 정보에 노출”되어 “상당한 오해”가 생겼다고 주장했다.

가디언은 다니엘 측에 논평을 요청했다.

어도어에 따르면 남은 네 멤버 중 세 명은 소속사 잔류를 결정했고, 민지는 여전히 소속사와 협의 중이다.

2022년 데뷔한 뉴진스는 하이브에서 가장 성공한 아티스트 중 하나다. 다니엘을 상대로 한 소송 소식이 전해지자 팬들은 “뉴진스는 다섯이 아니면 없다”는 슬로건을 내걸고 소셜 미디어에 목소리를 높였다.

이 극적인 계약 분쟁은 지난해 하이브가 그룹의 프로듀서 민희진을 어도어 대표이사에서 강제로 축출했다는 의혹이 제기되면서 터졌다.

이후 뉴진스 멤버들은 민희진 복귀를 요구하는 최후통첩을 발표했지만 하이브는 거부했다. 그러자 멤버들은 불만을 공개하며 회사가 의도적으로 자신들의 커리어를 훼손했다고 주장했다.

베트남계 호주인 멤버 팜 하니는 소속사와 일하는 동안 “의도적인 소통 왜곡과 조작”을 포함한 부당한 대우를 견뎌야 했다고 주장했다. 지난 10월 그녀는 한국 국회에 출석해 이 의혹에 대해 감정이 북받친 증언을 했다. “세상의 모든 문제를 해결할 수는 없겠지만, 서로를 존중하기만 한다면 적어도 직장 내 괴롭힘과 희롱 문제는 없을 것입니다.”

다니엘도 연습생 시절 끊임없이 감시당했고 모든 식사를 회사의 승인을 받아야 했다고 주장한 바 있다. 어도어와 하이브는 이 주장에 대해 입장을 밝히지 않았다.

지난 10월 서울중앙지방법원은 이러한 의혹이 어도어와의 “회복 불가능한 신뢰 파탄”을 초래했다는 뉴진스의 주장을 기각했다.

몇 주 뒤 고용노동부도 팜 하니가 어도어를 상대로 제기한 직장 내 괴롭힘 진정을 기각했다. 멤버들은 법적으로 어도어의 근로자가 아니라 “예외적 주체”라는 이유에서다.

이 분쟁은 K팝 산업에 큰 파장을 일으켰다. K팝 스타의 근로자로서의 권리에 대한 논의에 불을 지폈기 때문이다. 현행법상 그들은 근로자 지위를 인정받지 못하고 있다.

가처분이 인용된 뒤 타임지에 보낸 공동 성명에서 뉴진스는 이렇게 말했다: “마치 한국이 우리를 혁명가로 만들려는 것 같다.”

11월 어도어가 혜인과 해린 두 멤버만 소속사로 복귀한다고 발표하면서 팬들 사이에서는 뉴진스 해체 우려가 커졌다. 그러나 몇 시간 뒤 하니, 다니엘, 민지도 복귀하겠다는 별도 성명을 발표했다. 물론 지금 와서 보면, 그것도 잠시뿐이었지만.

The K-pop record label Ador is suing a former member of megaband NewJeans for millions in damages, it has announced, a day after removing her from the group following a year-long dispute that saw the band allege mistreatment and attempt to leave their contract.

The compensation suit against Danielle Marsh, a 20-year-old Australian-born singer, comes months after a Seoul district court ruled that NewJeans’ five members must honour their contracts with Ador, whose parent company Hybe is also behind the K-pop sensation BTS. The band’s contract runs until 2029.

Ador is also suing an unnamed member of Danielle’s family and the band’s former producer Min Hee-jin for damages and as part of a contract break penalty, alleging they both bore “significant responsibility for causing this dispute and for NewJeans’ departure and delayed return”.

South Korea’s Yonhap news agency reported that the total amount sought from the three individuals amounts to nearly 43.1bn won (US$30m, £22m, A$45m).

NewJeans made headlines in November 2024 when they announced their decision to leave Ador, prompting the company to request an injunction barring them from any commercial activities. That request was granted in March.

Danielle’s contract has been terminated, the label said on Monday, as it was “determined that it would be difficult for her to continue as … an artist under Ador”.

The label claimed that NewJeans’ members had been “exposed to persistently distorted and biased information” which had led to “significant misunderstandings”.

The Guardian has reached out to Danielle for comment.

According to Ador, three of the group’s four remaining members have decided to stay with the label, while member Minji is still in talks with the company.

NewJeans, which made its debut in 2022, is among Hybe’s most successful acts. After the lawsuit against Danielle was announced, fans took to social media with the slogan: “NewJeans is five or nothing”.

The dramatic contractual dispute erupted last year following allegations that Hybe had forced out Min, the band’s producer, from her role as Ador’s CEO.

NewJeans members later issued an ultimatum demanding Min’s reinstatement, which Hybe rejected. The members then went public with their grievances, alleging the company had deliberately undermined their careers.

Vietnamese-Australian band member Hanni Pham claimed that the band had endured mistreatment, including “deliberate miscommunications and manipulation” while working with the label. In October she delivered emotional testimony before South Korea’s parliament over the allegations, saying: “I know it’s not going to solve all the problems in the world, but if we just respect each other, at least there will be no problems with bullying and harassment in the workplace.”

Danielle has also claimed that when she was a trainee in one of the idol boot camps, she was constantly surveilled and had to have all meals approved by management, an allegation Ador or Hybe have not responded to.

In October, the Seoul Central district court rejected NewJeans’s claims that the allegations had caused an “irreparable breakdown of trust” with Ador.

Weeks later, South Korea’s employment ministry also dismissed a workplace bullying complaint made by Pham against Ador, stating that the members were not legally employees of Ador, but “exceptional entities”.

The spat sparked panic in the K-pop industry, as it fuelled discussions around the rights of K-pop stars as workers, a status they have been legally denied.

In a joint statement to Time magazine after the injunction against them was granted, the band said: “It almost feels like Korea wants to turn us into revolutionaries.”

In November, Ador announced that only two members, Hyein and Haerin, would be returning to the agency, sparking fears among fans that NewJeans would split up. But Hanni, Danielle and Minji released a separate statement hours later clarifying that they would also return – but now it is clear, not for long.
